Student’s Death Prompts Wrongful Death Suit Against Horry County School District

Parents of an Horry County student filed a wrongful death lawsuit against the school district and the SC Department of Education one year after their son was killed on his way to school.

In November 2009, Rodney and Cathleen Chaplin’s son, Marc, 18, was killed when a school bus driven by 77 year old Michael Burns struck his motorcycle. The Highway Patrol charged the school bus driver with failure to yield the right of way.

The Chaplin family alleges that the Horry County School District negligently entrusted a school bus with an incompetent driver.  According to court records, the driver was found guilty of failure to yield the right of way in 2007.

The suit seeks actual damages in the amount of $600,000.00.

According to one report, the Chapin Family further claims that the school district violated the Freedom of Information Act when they failed to respond to prior request for records.
